X-Play Calls for Clarity Amidst PR Storm

[Editor’s Note: (11-08-12: 11:25 PM) Certain names were removed on the post due to the request of X-Play representatives. Also, we were informed that the X-play higher echelon will be presenting their official spokesperson on this whole event.]

In  a round-table discussion with media people, bloggers and X-Play Online. The company tried to clarify it’s position in regards to the whole Datablitz raid incident that happened last monday. X-Play entertained questions from the assembled people to add more light to the already muddled issue that has spurned the local gaming community.

During the “discussion” we were able to ask questions that have been plaguing the whole issue and here are some of the answers that we got.

Question #1: Up to what extent was X-Play’s hand was in the whole fiasco

X-play: When we found out that Datablitz was selling unauthorized copies of NBA 2k13. We reported to the authorities (CIDG) of the incident. We did not have influence on what actions CIDG took. We were just as surprised with what they did to the staff of the Datablitz branches.

Question #2: So you’re saying that you did not order the detaining of the Datablitz employees?

X-Play: Yes, and in regards to the human violations  that were purposely happening during the arrest, we did not know that. We were clearly left in the dark as to what CIDG did. We just wanted to report what happened to the proper authorities because we wanted things fixed legally.

The actions were left in the hands of the CIDG and we weren’t kept abreast on what happened.

Question #3: So how about the news reports regarding the apparent, smuggling or piracy which was released by local news stations? Also is there a connection between GMA  and you guys since people have been thinking that the news report was poorly done?  And propaganda against Datablitz (since they’re supposed to be partnered with X-play?)

X-Play:  In regards to that, we don’t have authority on what they (GMA) did. A reputable news organization like GMA wouldn’t let something like this affect their news reporting so we can’t really influence them. We were just as surprised with the reports that came out. As for the GMA connection, our joint partnership had ended recently. They’re just share holders now.

Question #4: The other question that has been plaguing the community is your claim for exclusivity of the distribution of NBA 2k13. How does that work?

X-Play: Take 2 Interactive recognizes X-Play as the exclusive distributor of the NBA 2k13 games in all platforms in the Philippines.

Question #5: So, if that’s the case, why didn’t Take 2 Interactive say something about it? And what is your proof of the agreement?

X-Play: You guys have to understand that the legal situation in the states is different here in the Philippines. Whenever a company releases a “statement” in the states they would need to go through a lot of legal counsels. We have informed Take 2 Interactive about this and they have been investigating as well.

We would love to release to the public the contract, but we were advised by our lawyers that we can’t do so for the meantime.

One of the X-play representative present on the event that he has the respect for Datablitz with their stance against piracy. However, Datablitz really did a number on them business wise specially since Datablitz was with them since day 1. They just wanted to bring the whole NBA experience to the local Filipino NBA fans and things went out of hand when the news reports came out and they were just as taken aback as the people who heard it first with what happened.

So basically that’s what happened during the discussion. X-play will eventually release the complaint forms that they filed to CIDG so if ever we’ll keep you guys informed with further developments.

As for their involvement in the actual raids itself, X-play is adamant that they have no hand in it at all.

“We’ll just have to  take this as a learning experience,” the X-Play representative muses

    This is a poor job at controlling the bad PR they received. So now Xplay is saying they just complained and the CIDG acted on their own. So ngayon kasalanan ng GIDG at di sila, naghuhugas lang ng kamay yan.

    XPLAY IS EGAMES, they’ve done this before. They raided Special Force and Crossfire when they’re own lousy Operation 7 failed. 

    The CIDG won’t do anything like this without the complainant totally aware of the actions. Xplay just wants to protect it’s overpriced games and sell off  it’s overstocked inventory. Since they weren’t able to dump the inventory on datablitz this is the punishment they are giving.

    Remember the fiasco around a decade ago when the “distributor” of Warcraft 3 raided internet cafes left and right to demand “monthly” fees for installing Warcraft 3 per computer? X-Play is run by the same guys using the same shady tactics. Its also run by IPVG, a company infamous for stock manipulation. 

    They are merely trying to wash their hands clean of the negative publicity but are they seriously trying to spin the issue by saying they had no hand in CIDG’s operation? Who are they kidding?

    Why know why not after the release of NBA? (is it because of the raffle? I think they didnt reach enough entries and it wouldn’t be profitable since nobody really buys their games elsewhere unless DB has no stocks) 

    Don’t they know that Datablitz is the number one seller for console games? isn’t it obvious that all gamer gets their games from Datablitz? I Think their marketing department isn’t that dumb to not notice that datablitz would also release 2k13 and would probably make more sales than their so called partners? 

    How about GamesXtreme? their so called “partners” they are the one who are selling jailbroken consoles with pirated games? 

    I am really angry with X-play your modus is so childish all you want is money, you can have the 2k13 but you will never get the trust and respect we have for datablitz

      I think X-Play is aware that Datablitz is the most popular game seller in the country but maybe they’re just protecting the other game sellers that recognized them as exclusive distributor and followed the standard retail price. Me and my brother will continue to purchase game boxes at DB especially this coming Xmas. Sana maayos na ito.

      They sell the game at 2,600 PHP. Practically 1K PROFIT (assuming Datablitz makes 300 – 500 profit on their 2k pricetag) Tubong lugaw yan and for what entering into an agreement with 2K and tellng them they will promote the game sa PIlipinas. I havent heard any marketing activities for the game. Have you? Personally, I think XPLAY is a shady company owned by GMA inc., plain and simple.

      They were present during the raids yes but do you expect the lawyers to tell the CIDG operatives how to do their work? Ano bang malay ng mga lawyers on what happened after the raid? They had to be there because that was the SOP, I should know because I’m a lawyer myself. If the lawyers were given a choice I’m sure they would have preferred not to go. So stop making it appear that its the lawyers fault, it was the CIDG who conducted the raid. Stick to the facts MOON!

        Yes, because the lawyers are suppose to know the law better than the lowly policemen. They are also there to protect the client’s interests. If they see that the policemen were not doing their job well and might be doing something that is not in line with the law and could likely damage their clients reputation, dapat sabihan nila yong police. Classic example is the raid conducted, now GMA / XPLAY is doing crisis management. If only their lawyers were more proactive or should I say more COMPETENT, they might not be in the sh@t they are into right now.

    People are just reacting without really knowing the real story… To be objective, I don’t think this will happen without any basis. I think Datablitz is the one monopolizing the market by slashing down their prices in order to eliminate their competition. Not to mention the small scale distributors. The question here is, how can they drop their prices so low? The answer is…. Hmmmm… Should we ask CIDG? Smuggled was the term? Was it?

    Datablitz is using this for their advantage. They are really handling their PR wisely, playing underdog to get the sympathy… Well, the truth will come out eventually.

DataBlitz has never sold any pirated games, not then, not now and not ever. The games are genuine, original stocks that came from legitimate suppliers, and had gone through the proper importation channels with taxes & duties properly paid.

        I too buy my games from DB but this got me thinking… why are they always a couple of hundred pesos cheaper than everyone else? Do they have this uncanny ability to get their stocks from “secret” sources that everyone does not know. It’s like in the pharmaceutical companies where grey market imports are sold much cheaper than stocks produced here in the PH. This makes a lot of sense, GREY market is the operative word here.           actually hindi nman talaga cheap yung price ng DB eh.. tapat lang po, dhil kung icoconvert mo yung original prices nun mga games na un sa ibang bansa eh.. mas mura pa nga dpat eh.. eh since n me mga binayaran n nga n tax ang datablitz, mejo nagmahal na xa ng hundreds or so.. pero hindi nman overpriced na kagaya ng ibang video game sellers jan.. isa na yung toy kingdom napaka mahal ng mga games nila at sobrang overpriced.. malaman laman ko eh.. sa XPlay pala nkuha ng games tong toy kingdom nto kya overpriced lagi ang mga items nila.. tsk tsk tsk.. hindi po cheap ang benta ng DB sa mga items nila.. tapat lang po sa presyo..

        Wow… so quick to reply. I guess Datablitz has people monitoring all the reports and blogs. I have nothing against DB or neither am I a supporter of the other camp. I’m just merely expressing “objectively” my opinion. Thanks for the effort for forwarding this article, but this doesn’t sit well with me. In my opinion, I don’t think it’s x-play’s fault that those people were detained. I think you are using unfortunate event “of your people” for publicity stunt! It’s really bad, stop doing that.

          I beg to disagree. It is XPlay’s people who are monitoring the reports hence the ‘impromptu’ PR meeting with select members of the media because of uproar caused by their mistep. Facebook deactivation, check. Erasing comments on their website, check.  On the other hand, those who support Datablitz, myself included, are just concerned gamers who see through Xplay’s tactics, have you seen the messages of support from the various gaming communities on Datablitz’ webpage? As the proverb says, you sow the wind and you’ll reap the whirlwind.

          It should be pointed out that DB’s 1st reply came on Wednesday, much later than X-Play’s explanation on their webpage. For that matter, GMA News Online already had statements from X-Play by the time they published their first article on the matter, whereas they were still waiting for DB’s response. The raids were well-organized and coordinated, hitting all DBs offices but without targetting more blatant offenders, such as those selling pirated material in the nearby areas.

          Alfredtan214, it was really the gaming community that got wind, talked about and passed on the news about the X-Play and the CIDG’s raid on DB’s stores way before DB’s 1st comment.

          Thus, for you to be condemning DB for ‘using unfortunate event “of your people” for publicity stunt’ without even checking the facts means that your opinion is NOT OBJECTIVE at all. You overlook the fact that the was initiated not by DB but by X-Play, that it was not DB but CIDG- and ultimately X-Play- who put those poor workers behind bars, who released the female staff simply because they were female (because if they were really suspects in the investigation, they’d have remained in Crame with the men), who are now doing their best to contain the PR damage without dragging in GMA 7 with them.
          Quite frankly, given your vigorous and unilateral attack on DB’s credibility, it’s hard to believe you claim that you’re not in any way linked to X-Play.You see: even if DB had not spoken at all or done anything, the gaming community would still have been shocked at events, pissed off at X-Play, and supportive of DB and their staff who spend the night scared, intimidated and locked up in Crame. That’s the power of good service and good customer relations. If you don’t understand that as someone with an appliance distributorship, then I just pity you.

      Have you heard about bulk order discounts or volume discounts? Sa tagalog pakyawan? The smaller distributors just buy their wares at the current cost thst is why they can not compete with bigger distributors who buy wholesale and are given considerable discounts by their supplier. Datablitz claims they pay the right taxes with BOC, so smuggling is not an issue.

        Hi! Yes I heard of bulk order discount. But have you heard of exclusive distribution? I guess you are not reading the articles properly or you only reading what you like. So let me explain this to you, based from my understanding of the statements that were released, x-play is the exclusive distributor of NBA2K13 here in the Philippines. So everyone who wants to sell this particular game becomes sub-distributor. Meaning, the sub-distributors should only purchase this particular item for reselling, from the exclusive distributor. I don’t know who gave Datablitz the volume discount you were talking about, but if not x-play then that’s illegal purchase slash distribution of goods. So the question here, sa’an sila na mamakyaw? Do you know? Pa share naman oh…

          I was just answering your query about how they can drop the cost so low. If you are in buainess, you should know about this. I dont work for Datablitz so I wouldnt know their supplier. Maybe 2k singapore or whatevr which is irrelevant to the pricing. And yes I also know about exclusive distribution, Since you seem to be in the know, are you an XPLAY employee? XPLAY can claim exclusive distribution but have not provided documentation from 2k Interactive to back their claim. Meron ka bang kopya nong agreeement? Publish mo naman. Hingin mo sa boss mo. Hehehe.

            Nope I’m not an employee of X-Play. I have an appliance distributorship so I understand the system. My know how came from the articles/statements the I read from both parties. Read it properly, it’s there. Everything I said. If I get a copy of the agreement, I would gladly show it to you. Again if you read the articles properly, you can find the answer to your question as to why they haven’t provided the documentation of exclusive distributorship. Just scroll up and read question number 5. Second paragraph “We would love to release to the public the contract, but we were advised by our lawyers that we can’t do so for the meantime.”

              You honestly believe the X-Play spin doctors would be telling the truth now? They are covering their asses, plain and simple.

              They are not releasing the documents because there is nothing of the sort indicating they are the sole and exclusive distributor.

              If their claim is true and legally iron-bound, they’d have NO REASON to withhold that information, especially where it’s at the heart of their case and will immediately and undeniably settle things at once.

              For you to believe them just like that while being so doubtful and condemning of DB and the honest sympathy it’s getting from its customers SHOWS how biased you are in favor of X-Play.

              Claim all you want that you’re not an employee of X-Play; how you’ve been acting on this topic here in the comments speaks volumes about you.

          Alfredtan214, I’m not sure if you fully understand the idea of exclusive distribution. X-Play may be the exclusive distributor of NBA2k13, but it also has a distribution agreement depending on the specifics of the case. Exclusive distribution do allow authorization to certain dealers to sell, but it can create legal challenges. If the competitor can show that an exclusive distribution agreement harms competition, it may argue that the agreement is illegal.

          Also, NBA2k13 is not a high-end luxury product to have exclusive selling rights to. Moreover, it is not new that some businesses sell products that are not coming from exclusive distributors, which is more known as the ‘gray’ market. Last time I checked, gray products are not illegal. Kimstore has it and so are other online stores.

          To add, even if X-Play has 100% exclusive distribution rights over a single game, it doesn’t mean Datablitz is not allowed to get from other suppliers/dealers who would offer lower prices in a bundle. Also, there are region types for games like the PS3. Some are for the Asian region and the other Western. It could be that X-Play is exclusively selling a different region from what Datablitz is usually offering, which is Asian.

          You seem to be hopelessly defending X-Play huh? I smell “i-am-part-of-x-play” in here.

        Yes but according to X-Play, they are the exclusive distributor of NBA2K13 here in the Philippines. I think that X-Play is just protecting those small retailers/distributors who complied to the law and acknowledge them as exclusive distributor of the game.

      Nope, we call a spade a spade here. If this is not harassment and I don’t know what is. Their ground of ‘unfair competition’ in relation to ‘Section 179’ of the IP Law is laughable to us who studied the law. Even one who didn’t study the law but who know how to use Google would see what I mean. At least Xplay would be burning through cash with their lawyer fees and hopefully it will off set the 2.6 million peso worth of games they took. Good job Xplay on your self-immolation.

      Regardless, DataBlitz has claimed that its stock passes through the proper channels in Customs.  If DataBlitz stock are indeed smuggled, then Customs should be the one to complain.  Not the CIDG and definitely not X-Play

      With regard to small scale distributors, DataBlitz is not the only retailer with aggressive pricing.  ITech while some consider, a small scale business has so far been able to match DataBlitz in terms of pricing.  They have been able to keep pace with DataBlitz when it comes to meeting game release dates and they are also very aggressive when it comes to pre-orders.  As a consumer, I often find myself switching between both DataBlitz and Itech.  DataBlitz may have a bigger market share but they are NOT a monopoly.  The current competition between DataBlitz and ITech is proof of that.

       Alfredtan, how come datablitz is the one monopolizing in the first place if in the first place sila ang unang game store na may pinakamababang price? FYI 17 years na ang datablitz at kung sakali mang may ginawa ang datablitz that is illegal such as smuggling ay for sure lumabas na yun.Para sa akin masasabi kong unfair ang competition if xplay did it the other way around, kung saan ang xplay ang nag cut ng prices. Yeah tama ka hindi mangyayari ito without any basis, at yung basis na yun ay dahil naging gahaman ang xplay.

      Lawyer talk yan bro. Too much bad press for the company and now the mother company is being hit… hard by the controversy. If you read their replies, they are already shielding GMA Inc by saying tht they had severed their relationships “recently” but GMA is still the owner (stockholder) of XPLAY. Thats double talk para malessen negative impact ni Channel7. Likewise, sinisisi nila yong CIDG sa handling ng situation, when in fact their reps were there when the raid was made.
      Halatang may liability XPLAY at CIDG sa nangyari, IMHO. Fire fighting or crisis managment ginagawa nila ngayon. Di lang greedy kumpanya na to. Sinungzling pa.

    PR nightmare to sa GMA Inc. They should just let XPLAY close shop. They also wont be able to put the blame sa CIDG which obviously is their game plan right now. Tama na hugas kamay. You are just as fault as those bobo PO1s who raided DATABLITZ as if they were raiding Tayuman or Recto.

    I will not pay 500 – 1000 pesos more for a crummy T-Shirt and some raffle.  If I lose the raffle then that means I just wasted my money.

    I as a consumer have the right on what I choose to buy and not to buy.  And I choose not to support X-Play.  You will not get a single cent out of me.

    What about the Datablitz employees whose names were unfairly released by the CIDG?

    telling the public they had nothing to do on how the “RAID” went on .. gingawa ba nilang bobo ang mg tao?! eh di ba kpag dumulog ka sa CIDG i-bbriefing ka nila on how the “raid” or arrest will go?! amp .. gingawa pa nilang mamang mga pinoy gamers .. smuggling or whatever .. philippines is gray market .. kahit nga sa psn or xbox live wla ang pilipinas, so kung dito ka sa pinas ggwa ng mga online account, it’s either you choose singapore, hongkong or us .. kpag US pinili mo it’s your choice to buy from the US or find someone in the Philippines who sells games that are imported from the US. Telling the public they are the sole distributor .. f*ck yeah ..

    What the authorities should be focusing their efforts on raiding are the thousands of stores who sell copied pirated illegal software, movies, and games and their distributors – not resellers who sell original, legal, and legitimate games like Datablitz. 

    Considering the sorry state of legit games/movies/intellectual property in the Philippines. A market overrun by pirated games and fake DVDs resellers – distributors of original games should be helping each other instead of going into costly raids and lawsuits. These legal expenses will affect the business of both sides and the only way they can recover is through the sales of their games – which means higher prices at the expense of the legal-game-buying-customer. 

    It does not matter now if Xplay owns the rights legally, they handled this issue very very poorly and soiled their reputation then reaped the ill will of the Pinoy gamers even before they are well known.  You know, the kind of gamer who actually buys original games. So this is a PR disaster for Xplay in epic proportions.

    THIS IS A VERY LAME EXCUSE. Get your act together XPLAY. Your lawyers did not advice you to release any legal documents(if there is really any) because your lawyers are one of the people to blame regarding all this fiasco. This will not be a learning experience. I for one am interested to see a definitive legal action to be taken regarding this case. I am even surprised as to why this is only being discussed in the social media and not in the proper forums.

     If it is indeed smuggled, and we have to define what smuggled really means. Then I agree with you. But if by unauthorized in the terms of XPLAY , whcih means did not come from XPLAY, isn’t that monoploy? As per official statement from the datablitz camp their copy of the software came from legit sources in singapore and hongkong and paid appropriate tariff. How can that be smugled?

    hahaha, patay ang x play dito.  halatanga naghuhugas kamay na.  i do not know the actual facts but here is may pulis take:

    in every case, there must be a complainant.  especially in IPR cases, the ones who claim ownership about anything need to present solid proof about it.  this is not a kind of case that the CIDG can investigate moto propio.  so the claim of xplay that they have no hand in is plain bs.

    in the end, the biggest loser here is the CIDG.  pag bumitaw ang complainant dito, lutang sila sa ere.  paaano pag pumunta sa ombudsman ang datablitz?
